Can a man be permitted to marry his own biological daughter if she is borne to him out of wedlock according to the Quran?

Salam,

There is a blasphemous religious ruling in Islam that is taught and upheld by prominent Islamic scholars that reveals the approval of incest within its theology. In accordance with this teaching a man is permitted to marry his own biological daughter and consummate the marriage with her if she was conceived illegitimately. In other words, a man is permitted to marry his own biological daughter if she is born to him out of wedlock.

The foundation for this blasphemy is laid in the misrepresentation of the following verse:
It is He Who has created man from water: then has He established relationships of lineage and marriage: for thy Lord has power over all things. (Quran 25:54)

Al-Qurtubi in his Commentary (Tafsir) on Surah 25:54, he quotes Ibn Al-Arabi (1165 C.E.–1240 C.E.), the most influential author of Islamic history. He is also known to his supporters as al-Shaykh al-Akbar (The Greatest Master). Al-Qurtubi wrote:----------

“Lineage and relationship through marriage are two terms that describe the personal relationships that may exist between humans.” Ibn Al-Arabi said, “Lineage is an expression referring to the mixture of fluids between a male and a female from a religious legal point of view. However, if this union (between male and female) occurs through disobedience (fornication) then the resulting child is not considered a part of a person’s true lineage. That is why a daughter born from adultery is not mentioned in Allah’s saying, ‘Prohibited to you (for marriage) are: your mothers and daughters’ (Quran 4:23) because she is not considered a daughter according to the most authentic teaching of Sunni scholars. According to their interpretation if there is no legal lineage then there is no legal relationship; for adultery does not prohibit (from marriage) the daughter of the mother (you committed adultery with) nor the mother of a woman (you committed adultery with). What is lawfully prohibited is not also prohibited due to sin, for Allah has bestowed lineage and relation through marriage upon His servants and greatly esteemed these relationships. Allah has also established laws identifying what is legal and what is prohibited, which are not equal to each other; therefore falsehood cannot be a part of these laws.” (Tafseer Qurtubi, Qur'an 25 verse 54; Translated from Al-Azhar’s official website).

According to this opinion, a daughter born out of wedlock is not considered as the daughter of the man. Consequently, it becomes permissible for him to marry her. The above ruling clearly states that “the resulting child is not considered a part of a person’s true lineage.” As a result, the daughter is regarded the same as any other unrelated woman. As such, they claimed Islam does not prohibit the marriage between the father and his own biological daughter who is born through fornication or adultery.

And the above ruling also adds that, if there is no legal lineage then there is no legal relationship; for adultery does not prohibit from marriage the daughter of the mother you committed adultery with.” And to drive home the point, the ruling states, “What is lawfully prohibited is not also prohibited due to sin, for Allah has bestowed lineage and relation through marriage.” In others words, while the Quran prohibits marriages between a man and his daughter if she is conceived in marriage, it does not prohibit marriages between a father and his daughter if she is conceived out of wedlock.

How does having a daughter from an adulterous relationship make her sexually permissible for the father when she is in every sense his very own flesh and blood? No matter how she is conceived, she still remains his biological child and should be sexually off limits to him. This is a gross violation of the divine standard of morality. Just think, will the true God Allah permit incest intentionally?

According to those scholars Quran 4:23 speaks about the various types of marriage relationships that are forbidden in Islam. However, those scholars claimed that the list does not include the incestuous marriage between a father and his illegitimate daughter. Many of them acknowledge the permission of this incestuous marriage in the Qur’an. Al-Qurtubi confirms this point in his Commentary on Qur'an 4:23: “The scholars have differed on the issue of prohibition of sexual intercourse with someone born out of adultery. The majority of knowledgeable scholars have said that if a man commits adultery with a woman, that act does not prohibit him from marrying her. Likewise, a man’s wife is not prohibited from him if he commits adultery with her mother or her daughter. It is sufficient for him to receive the punitive judgment (based on sharia), and then he may have intercourse with his wife. If any man commits adultery with a woman then desired to marry her mother or her daughter, they are not prohibited from him because of this act.”

However It was reported by Malik that adultery prohibits (a man’s relationship with both) the mother and the daughter and this act (of adultery) has the same prohibitions that a legal marriage has. However, the (only) correct portion of Malik’s saying is that adultery produces no regulations. For Allah, exalted and glorified, said in Surah 4:23, “Your wives’ mothers,” but did not say, “He who committed adultery with his wives’ mothers, nor his daughter whom he conceived through adultery.” This is the saying of Al-Shafi’i and Abu Thuri…” Abdul Malik Ibn Al-Maj-shun said such a marriage (between a man and the daughter he conceived through adultery) is permissible; which they claimed is the correct understanding of Allah’s saying in Surah 25:54, “It is He Who has created man from water: then has He established relationships of lineage and marriage,” referring to an approved legal marriage. This is referred to the previous note on “Tafsiral-Qurtubi, Translated from the official website of Saudi Arabia, Ministry of Islamic Affairs).

The above “Tafsir” clearly states that “a marriage between a man and the daughter he conceived through adultery is permissible; by interpreting of Allah’s saying in Quran 25:54.” The reason for such strong support by these scholars for a practice that is morally and ethically wrong is primarily because of the Qur’an’s insistence that lineage and relationship are only recognized through “legal marriage.”

Note again the commentary by al-Qurtubi on Surah 4:23: For Allah, exalted and glorified, said in Quran 4:23, “Your wives’ mothers,” But did not say, “He who committed adultery with his wives’ mothers, nor his daughter whom he conceived through adultery.”

Thus, it can be noted that in this instance, incest between a father and daughter is sanctioned by them and this tarnished Islam for two reasons. They claimed firstly, it is because Allah does not recognize the lineage of the daughter who is born out of wedlock. Secondly, it is because Allah did not forbid this form of incestuous marriage in the Qur’an. As a result, a man’s daughter becomes permissible to him if he is not married to her mother at the time of her conception. Another renowned scholar also confirms this judicial ruling in Islam. Al-Fiqh Ala al Madahib al Arba’a by Sheikh Abdurehman Jazri, Volume 4, page 40: “It is permissible for a man to marry his daughter who is born through adultery.” “The one (girl) who is born through adultery does not become “mahram” (to her father) as the Shafiee say, because she is not considered as daughter since there is no inheritance between them.” In the legal terminology of Islamic sharia, “mahram” is an unmarriageable kin with whom sexual intercourse would be considered incestuous. However, since a daughter born from adultery is not a daughter in Islam, she “does not become mahram (forbidden) to her father.” As such, the father can marry her. Hence, the unacceptable practice of incest becomes acceptable for them in this instance. The forbidden becomes permissible

The great majority of Sunni scholars have enacted laws based on the Qur’an, which they think allow a man to marry his very own daughter if she is born out of wedlock – even when he is fully aware that she is his own flesh and blood. In other words he can knowingly marry his daughter because to them Islam “does not prohibit from marriage the daughter of the mother you committed adultery with.” Thus it permits a man’s illegitimate daughter to become his legitimate wife.

Look carefully at the wordings in this blasphemous ruling. It says, “It is permissible for a man to marry his daughter who is born through adultery.” It recognizes the fact that she is “his daughter” and yet permits the incestuous marriage between a father and his daughter. Can any sane person accept this insanity? Any human being with even a minuscule trace of decency will understand that although adultery is wrong, it does not change the fact that the child is still his biological daughter. If a man is not even supposed to marry his step-daughter, how much so if she happens to be his very own flesh and blood?

The depth of this immoral law is immense. To say it is shocking is an understatement.
Granted, a man and a woman sinned by committing adultery. However, to make the daughter of this union permissible for the father to marry is disgustingly sinful. This act of sin permitted by those scholars goes against the very order of nature. When those scholars say that the child “is not considered a daughter,” it is punishing the child for the sins of the parents. The fact that most fathers under such circumstances will not live by this ruling shows that even adulterers have a better moral standard than those blasphemous scholars. One might sin in a moment of weakness but their sins are deliberate and grossly wicked. This proves their “fatwa” is satanic in nature not only by sanctioning incest but by also punishing the innocent.

The evidences in the Quran is clear against their “Fatwa” and “Tafsir” of those unscrupulous scholars as Quran 4:23 forbids a person to marry his own daughter as stated:-“Prohibited to you (For marriage) are:- Your mothers, daughters, sisters;……and more important the verse says “born of your wives to whom ye have gone in,- no prohibition if ye have not gone in;” Whether they are legally married or not the daughter is still from both their semen.

And it is also clearly stated in the Quran if the father is guilty of fornication he is not only being forbidden to marry his out of wedlock daughter but also he is forbidden to marry  any other believing woman. The Quran strictly limit his partner to be of the sinner adulteress like him or a pagan woman. To the believers marrying such person is forbidden as stated:----------

Let no man guilty of adultery or fornication marry and but a woman similarly guilty, or a pagan: nor let any but such a man or an Unbeliever marry such a woman: to the Believers such a thing is forbidden.(Quran 24:3)

Islam as Misunderstood by Christians

Salam,

The text below is a collection of subject matters about Islam that is misunderstood by non-Muslim especially the Christians. Below is a list of those misunderstood factors that is being put forward for us to ponder as they think nothing defies logic like Islam:-

The challenge that Muhammad did not claimed himself a Prophet

The Christians claimed Muslims ask them to show where Jesus claimed to be God in the Bible yet they cannot show you where Mohammed claimed to be a prophet from the Qur'an. Below is a verse in the Quran which proclaim Muhammad’s claim not only to be a messenger but also a Prophet of Allah:-

Say: "O men! I am sent unto you all, as the Messenger of Allah, to Whom belongeth the dominion of the heavens and the earth: there is no god but He: it is He That giveth both life and death. So believe in Allah and His Messenger, the Unlettered Prophet, who believeth in Allah and His words: follow him that (so) ye may be guided." (7:158)

Islam claims Jesus is a prophet of Islam lower than Mohammed.

Islam never claim Jesus (Pbuh) is lower than Muhammad (Pbuh) in fact we are commanded to treat them equal and those who believe obey Allah’s command and there is reward from Allah for not differentiating among the messengers as stated:-

The Messenger believeth in what hath been revealed to him from his Lord, as do the men of faith. Each one (of them) believeth in Allah, His angels, His books, and His messengers. "We make no distinction (they say) between one and another of His messengers." And they say: "We hear, and we obey: (We seek) Thy forgiveness, our Lord, and to Thee is the end of all journeys." (2:285)

And those who believe in God and His Messengers and make no division between any of them, those -- We shall surely give them their wages; God is All-forgiving, All-compassionate. (4:152)

Islam claims Jesus is a prophet of Islam lower than Mohammed yet the Quran states that Jesus was sinless but Mohammed was sinful.

The Quran teaches Muslims that messengers and prophets were human beings and human makes mistakes and they cannot avoid being sinful in their life time and proof that even Jesus sinned is not only stated in the Quran but also in the Bible as stated:-

Jesus incurred Allah’s anger when he said as stated In the Quran - Said Jesus the son of Mary: "O Allah our Lord! Send us from heaven a table set (with viands), that there may be for us - for the first and the last of us - a solemn festival and a sign from thee; and provide for our sustenance, for thou art the best Sustainer (of our needs)." Allah said: "I will send it down unto you: But if any of you after that resisteth faith, I will punish him with a penalty such as I have not inflicted on any one among all the peoples." (5:114-115).

And the Bible also confirmed Jesus sinned because he scolded his mother as stated- And both Jesus was called, and his disciples, to the marriage. And when they wanted wine, the mother of Jesus saith unto him, they have no wine. Jesus saith unto her, Woman, what have I to do with thee? Mine hour is not yet come. His mother saith unto the servants, whatsoever he saith unto you, do it. (John 2:2-5).

By scolding the mother the Bible showed a bad example on Jesus as the Quran is very particular how a parent is to be treated:- Thy Lord hath decreed that ye worship none but Him, and that ye be kind to parents. Whether one or both of them attain old age in thy life, say not to them a word of contempt, nor repel them, but address them in terms of honor.(17:23)

Jesus performed miracles but Mohammed performed none.

It is Allah’s prerogative to give miracles to whom He pleases and it is not a standard He imposed to show the status of the messenger but He commanded us to make no distinction among the messengers as the miracles is in His authority:-Ye they say: "Why are not Signs sent down to him from his Lord?" Say: "The signs are indeed with Allah: and I am indeed a clear Warner." (29:50). And We refrain from sending the signs, only because the men of former generations treated them as false: We sent the she-camel to the Thamud to open their eyes, but they treated her wrongfully: We only send the Signs by way of terror (and warning from evil). (17:59).

Jesus was taken alive to heaven but Mohammed died of food poisoning. Yet Muslims claimed Mohammed is greater.

According to the Quran Jesus is dead as he said it and there is no second coming:- "So peace is on me the day I was born, the day that I die, and the day that I shall be raised up to life (again)"! (19:33). And there is another evidence shown in the Quran that Jesus is dead as Muhammad is dead and will be resurrected only on the Day of Judgment. On that day Jesus said he was not a witness to Christians worshipping him as god or son of god and that is why he said as stated in the Quran:-"Never said I to them aught except what Thou didst command me to say, to wit, 'worship Allah, my Lord and your Lord'; and I was a witness over them whilst I dwelt amongst them; when Thou didst cause me to die Thou wast the Watcher over them, and Thou art a witness to all things. (5:117).

If he is alive today and is coming to this world a second time he would have said in the Day of Judgment that he was a witness to billions of Christians worshipping him! He will not because he died before Christians worshipped him!

Islam says Allah is ONE yet Allah addresses himself as we.

This is a common language structure when God refer Himself as “We” it is a plural of authority and as an example when He says “For that We pour forth water in abundance (80:25) His angels will be doing the work and He gave the order! On the other hand when He refers Himself as God He will never say “We are your Lord” He will say “I am” as shown: “"Verily, I am Allah: There is no god but I: So serve thou Me (only), and establish regular prayer for celebrating My praise. (20:14)

Verses to ponder

Never will the Jews or the Christians be satisfied with thee unless thou follow their form of religion. Say: "The Guidance of Allah,-that is the (only) Guidance." Wert thou to follow their desires after the knowledge which hath reached thee, then wouldst thou find neither Protector nor helper against Allah. Those to whom We have sent the Book study it as it should be studied: They are the ones that believe therein: Those who reject faith therein, the loss is their own. (2:120-121)

Christians claimed Quran at Surah 9:31 give deception and lie to Muslims about Christian’s belief.

Salam,

Many Christians claimed that Quran at Surah 9:31 give deception and lie to Muslims about Christian’s belief. They claimed they do take priests and anchorites as God.

The Quran at 9:31:
They take their priests and their anchorites to be their lords in derogation of Allah, and (they take as their Lord) Christ the son of Mary; yet they were commanded to worship but One Allah: there is no god but He. Praise and glory to Him: (Far is He) from having the partners they associate (with Him).

For the information of Christians,  the Quran never lie about anything and it is telling the truth that Christians do take their priest and anchorites as lords in derogation of Allah. The Quran also provide proof of this statement from the Christian Bible itself. The verse (9:31) is broken into two fragments for easy reference and justification:-

The Quran says “They take their priests and their anchorites to be their lords in derogation of Allah, and (they take as their Lord) Christ the son of Mary;”

Here for easy justification the example of the Jews is taken into account as they take Ezra as their priest and anchorite and thus take him as the son of God and the Christians do the same except that the Christians take Jesus as the son of God.

The example of the Jew in Ezra he was also called Ezra the Scribe and also Ezra the Priest. He was also authorized to teach as stated in the Bible: For Ezra had prepared his heart to seek the law of the LORD, and to do it, and to teach in Israel statutes and judgments (Ezra 7:10). Since he was a teacher they called him Rabbi and according to Jewish tradition a Rabbi is also known as the son of God and this is where the Quran says they take their priests and their anchorites to be their Lords in derogation of Allah. Similarly the Christian takes Christ the son of Mary as the Jew take Ezra as Rabbi and a Jew confirmed Jesus is also a Rabbi and according to Jewish tradition he is the son of God. The part of the Bible that confirmed a Jew declared Christ a Rabbi and son of God is as stated:-

Philip findeth Nathanael, and saith unto him, We have found him, of whom Moses in the law, and the prophets, did write, Jesus of Nazareth, the son of Joseph. And Nathanael said unto him, can there any good thing come out of Nazareth? Philip saith unto him, Come and see. Jesus saw Nathanael coming to him, and saith of him, Behold an Israelite indeed, in whom is no guile! Nathanael saith unto him, Whence knowest thou me? Jesus answered and said unto him, Before that Philip called thee, when thou wast under the fig tree, I saw thee. Nathanael answered and saith unto him, Rabbi, thou art the Son of God; thou art the King of Israel. (John1:45-49). So in the Bible the Jew confirmed a Rabbi is the son of God and a Rabbi is a teacher and a master which the Christians looked upon Jesus. So the Quran tell the truth of the Christians belief by giving evidences from the Bible itself.

In the part of the vcerse 9:31 the Quran also said “yet they were commanded to worship but One Allah: there is no god but He. Praise and glory to Him: (Far is He) from having the partners they associate (with Him).”

Stated in the following are verses of the Bible commanding the Christians to worship one God: For thou shalt worship no other god: for the LORD, whose name is Jealous, is a jealous God: (Exodus 34:14); And in another verse Jesus answered and said unto him, Get thee behind me, Satan: for it is written, Thou shalt worship the Lord thy God, and him only shalt thou serve. (Luke 4:8)

Thus the accusation that the “Quran at Surah 9:31 give deception and lie to Muslims about Christian’s belief is unjustified as the Bible itself proved and confirmed that they do take their priests and anchorites in derogation of Allah.
